1  Auction Items

All Auction and Buy Now items listed on you.bid are sold on an “as-is” basis. This means that the items are sold without any warranties, guarantees, or returns. By participating in our auctions, you acknowledge and agree that:

• No Warranties or Guarantees: Unless specifically stated in the item description, auction items do not come with any warranties, either express or implied. This includes warranties of merchantability, fitness for a particular purpose, or availability of repair or service.
• Final Sale: All sales are final, and no refunds, returns, or exchanges will be provided for auction items. You are encouraged to review all item details, descriptions, and images carefully before placing a bid.
• No Guarantees of Condition: Items are sold as described by the seller, and no guarantees are made regarding the condition of the item upon delivery. Any defects or issues must be considered when placing bids.

2  Marketplace Items

Items sold through our Marketplace are also offered on an “as-is” basis. Many of these items may be new or unused, but they are often sold at prices below the Original Retail Price (ORP) due to factors like business liquidation or clearance.

• No Warranties on Marketplace Items: Unless otherwise stated, Marketplace items do not come with warranties or guarantees. While some items may be new, they are sold at a discounted price, and any manufacturer’s warranty, if applicable, will need to be claimed directly with the manufacturer.
• Final Sale: Returns or refunds for Marketplace items are not permitted. Buyers are encouraged to carefully review all available information before purchasing, as these items are sold as-is without the possibility of exchange or return.

3  Warranties and Indemnity

• No Liability for Losses: you.bid and its affiliates, officers, directors, employees, and agents are not liable for any loss, damages, or harm that may arise from your use of our site, participation in auctions, or purchase of Marketplace items. You agree to accept full responsibility for your use of the site.
• Indemnification: By using our services, you agree to indemnify and hold you.bid and its related entities harmless from any claims, demands, proceedings, losses, and damages (including legal fees) arising from your use of the site, your violation of any law, or breach of these terms.

4  Australian Consumer Law

Subject to any rights you may have under the Australian Consumer Law:

• We do not make any guarantees about the fitness of auction or Marketplace items for a particular purpose.
• We cannot ensure that items can be repaired, replaced, or serviced beyond any applicable vendor’s warranties.
• We are not liable for replacing or exchanging any items found to be defective upon delivery unless specifically required by Australian law.

5  Payment and Transaction Disclaimer

• We provide payment gateway services for your convenience. However, you.bid makes no warranties regarding the performance of these facilities. We are not liable for any errors, malfunctions, or disruptions in payment processing. If any payment-related issues arise, we encourage you to contact us immediately for assistance, but we do not guarantee resolution.
